In the law of Immigration there is nothing stronger than marriage with a citizen
Question: Lawyer, I am here without documents. I am married with a citizen, and my supervisor from work also mentions that he is aware to submit an application for me. Which method is favorable? I do not want my wife to think that I only married her to fix my papers.
Answer: In the law of immigration, there is nothing stronger than marriage with a citizen in reference to your marriage with a citizen from this country. Your wife should apply for you. If you apply for citizenship in reference to your job, first you have to show that your job is special and that there are no citizens here that can actually handle the job. If the department of labor accepts the fact that there are no citizens that are eligible to do the job, than you can try applying with immigration to immigrate you for your job. The problem is that it takes time; sometimes it takes three to six years to get papers because there is a line of applicants that are also requesting a visa. On the contrary, if you apply for a visa through marriage, there is always a visa that is available when someone has a real marriage with someone that is a citizen. If someone has more than 180 days in this country without documents and handles their business with the government outside the country, they will have to ask for forgiveness. You qualify for forgiveness if you can demonstrate extreme suffering with your wife or your parents who can either be a citizen or a resident. The law will not permit for someone to receive forgiveness if they are trying to pretend that they are suffering because of their job or their companion. It’s curious, but in this aspect, the law neither considers suffering for children that are citizens. We can demonstrate only suffering with your wife. Your wife is suffering the most because she can see the children missing the presence of their father.
You do not want your wife to think that you married her only to fix your papers for the visa. But at the same time, you and your wife will have a better life when you become a legal resident here.
Until Next time!
